An Overview of the New Market

Ahead of the regulated online gambling market opening in the Netherlands, the Head of Legal at Endorphina has shared his thoughts about the new laws.

The new laws are due to come into effect on October 1st, 2021, and they will allow for four types of gambling:

  • Casino games in which the players play against the operator
  • Casino games in which the players play against each other
  • Bets on events during a sports match or on the outcome of sports matches
  • Bets on the results of horse races and harness racing organized by or under auspices of the Dutch Draf

The Netherlands Gambling Authority will oversee the market, and the regulator is already accepting license applications. There is no limit on the number of licenses that can be awarded, and each license will last for five years. In general, applicants should have their registered office based in the EU or EEA, but there are some acceptable exceptions.

Furthermore, in order to be granted a license, the continuity of the license must be reasonably guaranteed. This means that applicants must show that they are not bankrupt, under a moratorium of payments, and so on. The law also specifies that applicants must not have operated in the Dutch market for at least two years and nine months before the application was submitted.

Operators will have to pay tax based upon their gross gaming revenue. The tax rate is currently 30.1%, having been raised a few years ago to compensate for the loss of income for the country due to delays in the adoption of the Online Gambling Act. However, according to the regulator, the tax will be lowered back to 29% six months after the new laws come into effect.

It is widely expected that the Netherlands will soon have a thriving online gambling scene, and many of the world’s largest operators are preparing to enter the market.
