DraftKings Sued by Colossus Bets for Patent Infringement
Colossus Bets, the sports jackpots and gaming technology provider, has filed a US patent infringement suit against DraftKings.
The suit has been filed in the District Court for the District of Delaware, and it relates to an alleged infringement of seven Colossus Bets patents that cover sports betting and gaming products that include a cash out feature.
Colossus first notified DraftKings of its patent rights in 2018 and says that it has since “provided numerous notices of ongoing infringement”. It stated that the lawsuit is part of its “broader intention to defend its intellectual property” and added that it intends to take similar steps against Tabcorp in Australia.

Colossus Bets explained that it is seeking to recover all alleged damages available by law as well as increased damages for willful and deliberate infringement. Colossus holds a number of patents on sports bets and games featuring cash out, regardless of whether the Cash Out feature is used by the player.
DLA Piper, the global law firm, is representing the company in the litigation. So far, there has been no comment from DraftKings.
Colossus Bets has patent license agreements with bet365 and Esports Technologies. In addition to the US gambling market, the company’s patent portfolio covers Australia, Japan, South Korea, the Philippines, Indonesia, South Africa, Singapore, Nigeria, and Eurasia.
