Missouri Casino Workers Secure Settlement from Penn National Gaming
LISTEN TO THIS ARTICLE:In 2023, a class action lawsuit was filed by casino workers in Missouri against Penn National Gaming and two of its Missouri casinos, the Argosy Riverside Casino and Hollywood Casino St. Louis.
The lawsuit claims revealed that the three workers’ paychecks were reduced illegally. Specifically, the workers accused the companies of deducting costs for maintaining, obtaining, and renewing gaming licenses from their pay.
Additionally, the employees alleged that a tip pool was established for table game dealers, which was then used to fund paid leave for non-tipped staff, such as supervisors and managers.

$5.5 Million Settlement Approved by Judge
The lawsuit argues that Penn National Gaming, along with its two casinos, violated several laws including the Fair Labor Standards Act, the Missouri Minimum Wage Law, and the Employee Retirement Income Security Act.
The legal team representing the plaintiffs includes George A. Hanson, Alexander T. Ricke from Stueve Siegel Hanson LLP, and Ryan L. McClelland with Michael J. Rahmberg of McClelland Law Firm, P.C.
It was recently reported that US District Judge Stephen R. Bough sided with the workers and endorsed a $5.5 million settlement. This decision, initially approved in January 2023, received its final confirmation on May 25.
Unspent Settlement Funds Donated to Charity
Out of the agreed $5.5 million settlement, 35% will pay attorney fees. Any unclaimed funds from this settlement will be donated to The Kaufman Fund and Angels’ Arms, two charitable organizations.
In other Missouri gambling news, there is a push for legalizing sports betting in the state. Twelve ballot initiatives, backed by both professional sports teams and legislators, are in the pipeline. These initiatives aim to introduce legal sports betting in Missouri, with each proposal requiring a minimum of 171,592 signatures by May to be included in the November Ballot.
